The Firm obtained settlements totaling $255,000.00 in the actions styled Cause No. D-0209754; Tiara Monique Allen v. Aiden Britt McKague and Aaron Britt McKague; In the 136th Judicial District Court of Jefferson County, Texas; and Cause No. D-210929; and Tiara Monique Allen v. Protective Insurance Company; In the 136th Judicial District Court of Jefferson County, Texas. The litigation arose out of a motor vehicle accident that occurred in Beaumont, Jefferson County, Texas. Our client’s vehicle was parked in the roadway when it was struck by another motorist. Significantly, our client’s vehicle was unlawfully parked in the street at the time of the incident.
Our client sustained back and neck injuries. The alleged tortfeasor’s insurer, after initially disputing the claim on the basis that our client was unlawfully parked on the street and therefore, so the argument went, helped to cause the incident, tendered the applicable policy limits. The Firm then successfully pursued an underinsured motorist claim on behalf of our client. After disputing the nature and extent of our client’s injuries, as well as raising a coverage issue, the underinsured carrier settled on terms favorably to our client approximately one hour after receiving a copy of the declaratory judgment action filed against the insurer.
