The Firm recovered $1,339,500.99 on behalf of a family in connection with a bus accident case that tragically killed multiple people, including the spouse of the Firm’s client. The Firm brought wrongful death claims on behalf of the widow and two Minor children, as well as the Decedent’s parents.
The litigation (Cause No. 2015CVT002221D3; Jose Alfonso Sifuentes Torres v. Turimex, LLC and JDK Transport Company; In the 341st Judicial District Court of Webb County, Texas) arose out of bus crash that occurred in Weimar, Texas. The bus was transporting migrant farm workers to North Carolina when the bus driver, who was speeding and paying insufficient attention to the road, crashed into a tractor-trailer combination which was stopped for construction. The bus driver was acting within the course and scope of his employment with Turimex at the time of the crash.
The Firm was hired after multiple law firms rejected the case on the basis of a release previously signed by our widow client. The Firm thoroughly investigated the circumstances surrounding the execution of the purported release and found that it was wrought with fraud. The Firm, undeterred by the purported release and the affirmative defenses of accord and satisfaction, release and payment, among others, marched forward and recovered nearly 1.5 million dollars on behalf of the family.
