Confidential Settlements Multi-Fatality Accident in Construction Zone

The Firm successfully recovered significant settlements, for confidential amounts, from various defendants in a triple fatality accident case that occurred in the Winter Garden Region in Texas. The incident occurred in a construction zone and involved, among other things, allegations that certain highway contractors failed to adhere to the traffic control established by TxDOT and/or were otherwise negligent in the enforcement and execution of the plan. We were able to overcome multiple motions for summary judgment filed by the general contractor, which alleged immunity pursuant to Section 97.002 of the Texas Civil Practice and Remedies Code (providing statutory immunity to highway contractors in compliance with the contract documents with TxDOT), as well as a subsequent attempt to appeal the interlocutory Order denying summary judgment, which would have resulted in years of delay.
