18-Wheeler Accident Case

The Firm successfully resolved our client’s claims for the policy limits of $750,000.00 in Cause No. 15-01-30530-MCV; Raul Vasquez v. BR Transport LLC, Saul Baldomero Rodriguez Sanchez d/b/a Auto Transporte de Carga and Rolando Ivan Realme Sanchez; In the 293rd Judicial District Court of Maverick County, Texas, removed to federal court via Civil Action No. 2:17-cv-00008-AM-CW; Raul Vasquez v. BR Transport LLC, Saul Baldomero Rodriguez Sanchez d/b/a Auto Transporte de Carga and Rolando Ivan Realme Sanchez; In the United States District Court for the Western District of Texas, Del Rio Division, and later remanded back to the State Court in Maverick County, Texas.


The case involved a motor vehicle accident that occurred on FM 1021/El Indio Highway in Maverick County, Texas, and occurred when a truck driver, jointly employed by a Mexican trucking company and a Texas entity controlled by the Mexican company, failed to yield the right-of-way as he attempted to make a wide, right-hand turn and head westbound on FM 1021/El Indio Highway, in the same direction in which our client was traveling. The insurer initially denied liability and offered less than $25,000.00 to settle the case, which occurred prior to the case being referred to the Firm by the local attorney. Our client primarily suffered back and shoulder injuries. 


The Firm, following prolonged and contested litigation, which included extensive fact and expert discovery, multiple mediations and an improvident removal to federal court, resolved the case for the full policy limits of $750,000.00 shortly after the federal court agreed that the removal was improper and remanded the case back to the State Court. We also favorably resolved the case against the non-diverse trucking company, which fully disposed of the litigation.
