The Firm, working with other lawyers, recovered $545,000.00 for our client in an incident that occurred at an indoor trampoline park in South Texas. Our client sustained a cervical spine injury as a result of the incident.
While at the trampoline park, our client jumped on a trampoline into the foam pit located near the rear of the park and struck his head/neck, which required an anterior cervical decompression and fusion at the C4-C5 and C5-C6 levels. Defendants asserted that our client dove head-first into the jumping pit, contrary to company policy and signage located throughout the park. The deposition of the trampoline park’s corporate representative yielded many key admissions detailing the park’s various safety deficiencies. Despite having previously signed a waiver, and after overcoming Defendants’ motion for summary judgment on that ground, the case proceeded to mediation and settled shortly thereafter.
