Our client was a passenger in a Tahoe traveling on a highway in Galveston, when they encountered an individual operating a golf cart and attempting to cross the highway. The driver of the Tahoe attempted to evade the golf cart and, in the process, overcorrected and flipped the Tahoe several times. Our client was ejected from the Tahoe and sustained a catastrophic brain injury.
Claims of negligence were brought against the driver of the Tahoe, the golf cart operator and the establishment that rented the golf cart to the golf cart operator. Policy limits were recovered against the driver of the Tahoe and the golf cart operator. The claims against the business that rented the golf cart centered around its alleged failure to take appropriate action to ensure compliance with a local ordinance, which prohibits people from operating golf carts on roads where the posted speed limit exceeds 35 miles per hour.
